Emailyze Terms of Service
1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the Emailyze website, applications, email verification services, bulk processing tools, APIs, contact management features, campaign tools, artificial intelligence features, reports, and related services (collectively, the "Services").
By creating an account, purchasing credits or a subscription, accessing an API, using the public email verifier, or otherwise using the Services, you agree to these Terms.
If you use the Services on behalf of a company, organisation, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" and "your" refer to that entity.
If you do not agree to these Terms, do not use the Services.
2. About Emailyze
Emailyze provides software tools designed to help users:
- verify individual email addresses;
- process and verify email lists in bulk;
- classify email addresses using verification and risk signals;
- download verification results;
- create and manage contact lists;
- import contact data;
- create email templates using available editors and AI-assisted tools;
- configure sending profiles and third-party SMTP services;
- create and send email campaigns;
- monitor campaign and verification activity;
- access certain features through APIs; and
- use other related tools made available from time to time.
The specific features, usage limits, credits, and capabilities available to you depend on your selected plan, account status, and any additional services you purchase.
3. Eligibility and Account Authority
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an Emailyze account.
You may use Emailyze for business or professional purposes only where such use is lawful.
You agree to provide accurate and current account information and to keep it updated.
You are responsible for:
- all activity performed through your account;
- protecting your password, API keys, SMTP credentials, and other authentication information;
- restricting access to authorised users;
- promptly notifying us of suspected unauthorised access; and
- ensuring that anyone using your account complies with these Terms.
You must not share credentials in a manner that bypasses account, plan, credit, or user limits.
4. Public Quick Email Verifier
Emailyze may provide a limited email verification tool that can be used without creating an account.
The public verifier may be subject to:
- daily usage limits;
- IP-based or device-based limits;
- browser or session controls;
- automated abuse-prevention measures;
- CAPTCHA or other security checks; and
- temporary or permanent restrictions.
We may modify or discontinue free verification limits at any time.
You must not attempt to bypass, manipulate, automate around, or defeat free-use limits or other abuse-prevention controls.
Results generated through the public verifier are subject to the same limitations and disclaimers that apply to other verification results.
5. Email Verification Results
Emailyze may analyse technical and other signals associated with an email address and return classifications, scores, statuses, reasons, or related information.
Results may include categories such as:
- Valid or Deliverable;
- Risky;
- Invalid;
- Unknown;
- Disposable;
- Role-based;
- Accept-all; or
- other classifications introduced from time to time.
Verification results are estimates, not guarantees.
Email systems change continuously. A mailbox may be created, deleted, disabled, protected, temporarily unavailable, configured as accept-all, or affected by external systems after a verification is performed.
Accordingly, Emailyze does not guarantee that:
- every valid address will accept or receive an email;
- every invalid address will reject an email;
- a message will reach the inbox;
- a message will not be filtered as spam;
- a campaign will achieve a particular bounce rate;
- every disposable, role-based, risky, or accept-all address will be identified;
- a score or classification will remain accurate after the time of verification; or
- verification will detect every fraud, abuse, spam trap, or security risk.
You are responsible for deciding how to use verification results.
Verification does not equal consent.
A "Valid", "Deliverable", or similar result means only that Emailyze identified certain technical signals relating to the address.
It does not mean that:
- the person has agreed to receive email;
- you have a lawful basis to contact the person;
- the address belongs to your customer;
- the recipient has opted into marketing;
- sending to the address complies with applicable law; or
- the recipient will welcome or engage with your message.
You are solely responsible for determining whether you have the legal right to store, process, contact, or market to any person.
6. Contact Lists and Customer Data
You may upload, import, store, organise, verify, or otherwise process email addresses, contact information, lists, files, campaign information, and other data through the Services ("Customer Data").
You retain your rights in Customer Data.
You grant Emailyze a limited right to host, process, transmit, analyse, display, and otherwise use Customer Data only as reasonably necessary to:
- provide the Services;
- perform requested verification or processing;
- send campaigns you initiate;
- provide reporting and support;
- maintain security and prevent abuse; and
- comply with legal obligations.
You represent and warrant that:
- you have obtained Customer Data lawfully;
- you have all rights, permissions, consents, or other lawful bases needed to process and use it;
- your instructions to Emailyze are lawful;
- Customer Data does not violate the rights of another person; and
- you will not use Emailyze to create, enrich, process, or send to unlawfully obtained contact databases.
You must not upload data that you are prohibited from processing.
7. Campaign Sending and Your SMTP Provider
Emailyze may provide tools that allow you to prepare and send campaigns using SMTP credentials, sending profiles, or third-party email infrastructure configured or selected by you.
Unless expressly stated otherwise, Emailyze is not your email mailbox provider or underlying SMTP provider.
You are responsible for:
- obtaining and maintaining your SMTP or email provider account;
- complying with your provider's rules and sending limits;
- protecting SMTP credentials;
- configuring domains and authentication correctly;
- sender identity and reputation;
- bounce and complaint rates;
- unsubscribe handling;
- suppression lists;
- recipient permissions;
- campaign content; and
- all emails sent through your account.
You authorise Emailyze to use your configured sending connection only to perform actions that you request through the Services.
We do not guarantee:
- successful delivery;
- inbox placement;
- open or click rates;
- uninterrupted SMTP connectivity;
- acceptance by receiving servers; or
- continued availability of a third-party email provider.
A campaign marked as "sent", "delivered", "opened", "clicked", "bounced", or similar may depend on signals from third-party systems and tracking technologies and may not always be complete or perfectly accurate.
8. Anti-Spam and Responsible Sending
You may use Emailyze only for lawful email activity.
You must:
- contact recipients only where you have a lawful right or other valid basis to do so;
- use accurate sender and header information;
- avoid deceptive subject lines or identities;
- provide legally required sender information;
- provide an effective unsubscribe or opt-out method where required;
- honour opt-out requests within the time required by applicable law;
- maintain appropriate suppression lists; and
- comply with laws applicable to the sender, recipients, and campaign.
Depending on recipient location and circumstances, privacy and commercial-email requirements may arise under laws such as India's data-protection framework, the EU GDPR, and U.S. CAN-SPAM rules.
Emailyze does not determine whether your specific campaign is legally permitted.
You are responsible for obtaining legal advice where necessary.
9. Prohibited Uses
You must not use the Services to:
Spam or unlawful marketing
- send unsolicited messages unlawfully;
- knowingly ignore unsubscribe requests;
- use unlawfully obtained, stolen, or unauthorised contact lists;
- send to lists where you lack a lawful basis or required permission; or
- disguise the commercial nature or origin of a message where disclosure is legally required.
Fraud or deception
- conduct phishing;
- impersonate another person or organisation;
- harvest passwords or authentication credentials;
- operate scams;
- send fraudulent offers;
- mislead recipients about sender identity; or
- distribute materially deceptive content.
Harmful or illegal activity
- distribute malware, ransomware, viruses, or harmful code;
- facilitate illegal activity;
- threaten or harass others unlawfully;
- infringe intellectual-property rights;
- process prohibited data unlawfully; or
- violate applicable privacy, communications, or cybersecurity laws.
Abuse of the platform
- attempt to bypass usage, account, API, or credit limits;
- create multiple accounts to evade restrictions;
- probe, scan, or attack Emailyze infrastructure;
- interfere with service operation;
- reverse engineer the Services except where legally permitted;
- scrape or copy the Services or protected content without permission;
- resell account access or credits without written approval;
- use automated methods that exceed documented limits; or
- use verification features to facilitate unlawful harvesting, surveillance, or abuse.
We may investigate suspected abuse and suspend or terminate access where reasonably necessary to protect users, recipients, third parties, or the Services.
10. Templates and AI-Assisted Features
Emailyze may offer tools that generate or assist with:
- subject lines;
- email copy;
- campaign content;
- templates;
- layouts;
- suggestions; or
- other materials using artificial intelligence.
AI-generated output may be inaccurate, incomplete, unsuitable, repetitive, or similar to content generated for others.
You are responsible for reviewing all generated content before use.
You must not rely on AI output as:
- legal advice;
- financial advice;
- professional advice; or
- a guarantee of compliance.
You are responsible for ensuring that content you send:
- is accurate;
- does not infringe third-party rights;
- is lawful;
- is appropriate for recipients; and
- complies with advertising, marketing, and email laws.
Emailyze does not guarantee the originality, accuracy, legality, or performance of AI-generated content.
11. API Access
If your plan includes API access, you must:
- keep API keys confidential;
- use the API only for authorised applications;
- comply with documented request and rate limits;
- implement reasonable security controls; and
- promptly rotate compromised credentials.
You must not:
- share an API key publicly;
- bypass rate limits;
- use the API to disrupt the Services;
- use excessive automated requests;
- resell API access without permission; or
- attempt to obtain unauthorised access to data or systems.
We may throttle, restrict, rotate, or revoke API credentials where reasonably required for security, abuse prevention, technical stability, or Terms enforcement.
12. Plans, Credits and Usage Limits
Emailyze may offer:
- free plans;
- subscriptions;
- verification credits;
- AI usage allowances;
- campaign features;
- API access; and
- other paid services.
The applicable pricing, included features, and limits are displayed at the time of purchase or on the relevant pricing page.
Credits and account allowances:
- have no cash value;
- cannot be redeemed for cash;
- are non-transferable unless expressly permitted;
- may be limited to the account that purchased or received them; and
- may be subject to limits or expiration rules disclosed at purchase.
We may reject or reverse transactions reasonably suspected to involve fraud, abuse, payment disputes, or unauthorised activity.
13. Billing, Renewals and Taxes
For recurring subscriptions, you authorise the applicable payment provider to charge the payment method associated with your purchase according to the billing cycle shown at checkout.
Unless otherwise stated:
- subscriptions may renew automatically until cancelled;
- cancellation affects future renewal and does not ordinarily reverse completed billing periods;
- you remain responsible for charges incurred before cancellation; and
- taxes may be added where required.
You are responsible for maintaining valid billing information.
Refunds
Except where required by applicable law or expressly stated in a separate written refund policy, fees and consumed credits are non-refundable.
Before publishing this clause, confirm that it matches the policy you actually intend to follow.
14. Free Services and Trials
Free plans, trials, promotional credits, and free public tools may:
- have reduced functionality;
- have usage limits;
- expire;
- change;
- require conversion to a paid plan; or
- be withdrawn.
Free access is provided without a guarantee of continued availability.
You must not create multiple accounts or use other methods to obtain free allowances fraudulently.
15. Third-Party Services
The Services may depend on or integrate with third parties, including:
- SMTP providers;
- payment processors;
- infrastructure providers;
- artificial intelligence providers;
- analytics providers;
- authentication providers; and
- other software or APIs.
Your use of third-party services may be subject to separate terms and policies.
Emailyze is not responsible for failures, outages, policy changes, account restrictions, data handling, or other actions of independent third parties.
We may add, replace, or remove integrations where reasonably necessary.
16. Privacy and Data Protection
Our processing of personal data is also governed by the Emailyze Privacy Policy.
You are responsible for your own legal obligations relating to Customer Data.
Where you use Emailyze to process personal data on behalf of your organisation, you remain responsible for determining:
- your lawful basis for processing;
- required notices;
- consents where needed;
- retention periods;
- responses to individual rights requests; and
- any other compliance duties applicable to you.
You must not instruct Emailyze to process data unlawfully.
India's Digital Personal Data Protection framework governs certain processing of digital personal data, while the GDPR can apply in relevant European contexts.
17. Intellectual Property
Emailyze and its licensors own all rights in the Services, including:
- software;
- source code;
- interfaces;
- visual designs;
- branding;
- logos;
- documentation;
- underlying technology; and
- other proprietary materials.
These Terms give you a limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with your plan and these Terms.
Except where expressly permitted, you may not:
- copy;
- modify;
- distribute;
- sell;
- sublicense;
- reverse engineer;
- reproduce; or
- create derivative works from
- the Services or proprietary Emailyze materials.
"Emailyze" and related branding may not be used without permission.
18. Your Content
As between you and Emailyze, you retain ownership of content that you lawfully upload or create through the Services.
You are responsible for your content.
You represent that you have the rights necessary to use and instruct us to process that content.
You grant Emailyze only the limited rights needed to provide, maintain, secure, and improve the Services in accordance with these Terms and our Privacy Policy.
19. Feedback
If you voluntarily provide suggestions, ideas, or feedback about Emailyze, you permit us to use that feedback without restriction or payment, provided we do not publicly identify you as the source without permission.
20. Service Availability and Changes
We aim to provide reliable Services, but we do not guarantee uninterrupted or error-free availability.
The Services may be unavailable because of:
- maintenance;
- updates;
- technical failures;
- security incidents;
- third-party outages;
- internet or infrastructure failures; or
- events outside our reasonable control.
We may modify, improve, replace, or discontinue features.
Where a material change substantially affects a paid service, we will take reasonable steps to provide notice where practical.
21. Beta and Experimental Features
Features identified as beta, preview, experimental, early access, or similar may be incomplete and may change or be discontinued.
You use such features at your own risk.
Beta features may have additional limitations and should not be relied upon for critical operations unless expressly agreed otherwise.
22. Suspension and Termination
We may suspend, restrict, or terminate access where we reasonably believe:
- these Terms have been violated;
- payment is overdue;
- the account creates a security risk;
- the Services are being abused;
- unlawful activity is occurring;
- sending activity creates excessive complaints, bounces, or reputational harm;
- an authority or third party requires action;
- continued access could harm Emailyze, recipients, users, or third parties; or
- suspension is otherwise reasonably necessary to protect the Services.
Where appropriate, we may provide notice and an opportunity to remedy the issue.
Serious abuse, fraud, security threats, or unlawful conduct may result in immediate action.
You may stop using the Services at any time.
Termination does not eliminate obligations that arose before termination.
23. Disclaimers
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis.
Emailyze disclaims warranties that the Services will:
- always be available;
- be error-free;
- identify every invalid or risky address;
- prevent all bounces;
- improve inbox placement;
- increase campaign performance;
- meet every legal requirement applicable to your business; or
- produce accurate AI output in every case.
No statement, score, classification, analytics result, or recommendation from Emailyze constitutes a guarantee.
Nothing in these Terms excludes a right or warranty that cannot lawfully be excluded.
24. Limitation of Liability
To the maximum extent permitted by applicable law, Emailyze and its owners, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of:
- profits;
- revenue;
- business;
- goodwill;
- data;
- campaigns;
- customers; or
- opportunities.
This applies whether the claim arises in contract, tort, negligence, statute, or another legal theory.
To the maximum extent permitted by law, Emailyze's total aggregate liability arising from the Services will not exceed the total fees you paid to Emailyze during the 12 months immediately preceding the event giving rise to the claim.
These limitations do not apply where liability cannot lawfully be excluded or limited.
25. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Emailyze and its affiliates, personnel, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from:
- your Customer Data;
- your campaigns;
- messages sent through your account;
- your violation of these Terms;
- your violation of applicable law;
- your infringement of another person's rights; or
- your unlawful or unauthorised use of contact information.
26. Changes to These Terms
We may update these Terms to reflect:
- changes to the Services;
- new features;
- legal or regulatory developments;
- security requirements; or
- business changes.
The updated version will display a revised "Last Updated" date.
For material changes, we may provide additional notice where reasonably appropriate.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
27. Electronic Communications
You agree that we may send you service-related communications electronically, including:
- account notices;
- security alerts;
- billing communications;
- operational messages;
- legal notices; and
- other communications relating to your use of the Services.
Marketing communications will be handled in accordance with applicable law and available preferences.
28. Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles.
Subject to applicable mandatory law, the courts located in Mumbai, Maharashtra, India will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.
Nothing in this section prevents either party from seeking urgent injunctive or protective relief where legally available.
29. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
The unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where legally permitted.
30. No Waiver
A failure by Emailyze to enforce a provision of these Terms does not waive our right to enforce it later.
31. Assignment
You may not assign or transfer these Terms or your account without our written consent.
We may assign these Terms as part of a merger, acquisition, corporate restructuring, sale of assets, or similar transaction, subject to applicable law.
32. Entire Agreement
These Terms, together with the Privacy Policy, pricing terms, order details, and any additional terms expressly incorporated into them, form the agreement between you and Emailyze regarding the Services.
